7.1 www.2evolve.co.za is not an e-commerce website, as there is absolutely no processing of credit card details or payments through the website. Payments are either manually processed by Jeanneil Sales cc in South Africa or transferred to the nominated bank account of Jeanneil Sales cc in South Africa. All sales transactions are therefore considered to be concluded in the Republic of South Africa, governed by the laws of the Republic of South Africa and as per the terms and conditions of sale as stipulated by Jeanneil Sales cc.

8.1 Jeanneil Sales cc takes reasonable steps to protect the information of all of its users and will not sell or offer personal/corporate information to any entity or individuals unless required to do so in order to complete the sale (e.g.: Banks, Couriers etc) or unless required to do so by law.
8.2 Jeanneil Sales cc collects and stores specific information that will allow better service, product promotion and to properly transact with the individual purchaser. (eg. Geographical location, IP address etc.)

9.1 Any person who attempts to enter password protected pages, files, folders without written permission from Jeanneil Sales cc will be subject to prosecution and civil claims, and will be liable for any damages and all costs incurred, including legal costs on the attorney and own client scale.

12.1 If for any reason any of the provisions of these terms are not fully enforceable then the remainder shall continue to apply.

B - CONDITIONS OF SALE

For the purpose of these ‘terms and conditions of sale’,
'Jeanneil Sales cc' shall mean ‘2Evolve' and vice versa,

By requesting a quote or invoice, you (the ‘customer’) agree to the following terms and conditions of sale:

B1. Trade Mark, Registered Trade Mark names and Service Marks are the property of Jeanneil Sales cc, its affiliates, agents and principals. Written permission must be given from the respective owner/s for any commercial use of these marks, including but not limited to product advertising.

B2. All content found in Jeanneil Sales cc catalogues and data on their web sites including but not limited to, software, databases, text, graphics, icons, private information, designs and agreements, are the property of, or is licensed to Jeanneil Sales cc and as such are protected from infringement by both local and international legislation and treaties.

B3. All information contained in the web-sites and catalogues of Jeanneil Sales cc is based on data supplied by manufacturers and is deemed to be correct at the time of publishing. No Warranty is expressed or implied regarding the accuracy of this information.

B4. Unless otherwise specified;

(a) Payment must be made by the customer in full within three working days of acceptance of quotation and before any goods are released,
(b) Any Credit accounts must be paid within 30 days from the date of invoice, failure to pay within these terms will attract interest at the prime lending rate + 2.5% per month or part thereof. Debt collection on accounts older than 60 days will incur a debt collection fee of 25% of the full invoice value.

B5. Orders sent with a door to door courier nominated by Jeanneil Sales cc are insured against theft and damage, the cost of which insurance shall be incorporated into the cost of the goods. In the event that the customer requests that no insurance be taken out, and/or that the customer nominates and pays for the courier, such goods will be deemed delivered and all risk shall pass to the customer on receipt by the courier.

B6. All sales concluded with Jeanneil Sales cc are done with the understanding that;

(a) You have thoroughly enquired into the products suitability before each and every instance of usage,
(b) You have been adequately trained in the use of or clearly understand how to properly and adequately use each product purchased,
(c) As per product manufacturer requirements and relevant municipal (governmental) requirements, you have the appropriate facilities from which to use and store the purchased products.
(d) You will notify any potential customer or user about any known risks pertaining to the products, including commonly known risks, MSDS info, product label info and Jeanneil Sales cc known risks disclosures. (see: www.2evolve.co.za/safey.htm)
(e) You will ensure contaminated products (consumables and sharps) are disposed of safely and as per municipal (governmental) requirements.

No Warranty is expressed or implied regarding the merchantability or suitability of the products sold by Jeanneil Sales cc.

B7. Neither Jeanneil Sales cc nor any of its affiliates or principles shall be liable for any damages, losses or liability of whatsoever nature arising from misuse by or the inability of the customer to use any of their products.

B8. Returns of Unwanted or incorrectly ordered items may be credited against future purchases provided that;

(a) The customer has contacted Jeanneil Sales cc for a returns authorisation number and it has been granted by Jeanneil Sales cc in writing;
(b) Products are returned at the customers risk and expense directly to the physical address of Jeanneil Sales cc within seven working days of receipt;
(c) Jeanneil Sales cc receives the returned items in the original packaging, with a copy of the original invoice and they have not been in anyway used or damaged;
(d) Jeanneil Sales cc reserves the right to refuse the return of unwanted or incorrectly ordered products that have been specially imported or manufactured for the customer or to charge a 50% restocking fee in order to recover potential loses.

B9. Returns of defective items;

(a) Will only be accepted after the customer has contacted Jeanneil Sales cc for a returns authorisation number and it has been granted by Jeanneil Sales cc in writing and defective items are returned within their respective warranty period; items found not to be defective or not covered by the individual product warranty must be collected by the customer (at their cost) within 30 calendar days of notification to collect or the item/s will be discarded.

B10. For Hygiene reasons there is absolutely no warranty offered and no returns accepted on opened or used: Tattoo/piercing After Care Products, Tattoo/piercing Needles, Tattoo/piercing Consumables, Disinfectants, Sanitisers , body piercing jewellery and Tattoo inks, save where such items are materially defective and impossible to be used, rather than merely unsuitable for the customer.

B11. Without express written permission and a signed sub-dealer agreement in place, no customer may purchase any Tattoo and Clean Room related products with the intention of reselling.

B12. Jeanneil Sales cc in it's sole discretion, may reasonably change this agreement or any part thereof at any time without notice, subject to the provisions in Consumer Protection legislation.

B13. Severability: If for any reason any of the provisions of these terms and conditions of sale are not fully enforceable then the remainder shall continue to apply.

B14. Jeanneil Sales cc chooses as its domicilium citandi et executandi for all purposes under this agreement as 1 Taaibos Close, Plattekloof, 7500, Cape Town, South Africa.
